Terms of use for Fred. Olsen Tarjeta Plus

PLEASE READ THESE CONDITIONS CAREFULLY AS THEY CONSTITUTE THE TERMS OF THE CONTRACT YOU MUST ACCEPT IN ORDER TO PARTICIPATE IN THE FRED. OLSEN PLUS PROGRAMME.

PARTICIPATION IN THE PROGRAMME

1. The purpose of Fred. Olsen Plus is to constitute a customer loyalty programme, offering customers ferry trips or other products in exchange for using the services of Fred. Olsen Express.
2. Members of this programme are natural persons who, having correctly completed the application form, have accepted the conditions of participation in the programme.
3. Each member of Fred. Olsen Plus will have a unique identification number in the programme, which will be personal and non-transferable.
4. The earning of points is personal to each loyal customer and therefore, in order to earn points, the customer must also be a ticket holder or a direct user of the services that give rise to points. Points are not transferable, exchangeable for money or any other kind, or negotiable under any circumstances.
5. The points obtained for the use of our services do not expire, except in the event that, during ONE calendar YEAR, there have been no movements by the customer in the Fred. Olsen Plus programme, either to obtain new points or to dispose of previously obtained points.

EARNING POINTS:

6. When purchasing a Fred. Olsen Express ticket, members of the Fred. Olsen Plus programme who are holders of that ticket will receive a number of points based on the amount of the ticket purchased.
7. The value of points per euro will be established by Fred. Olsen Express, and its value will be available to customers at all times.
8. Excluded from earning points for the Fred. Olsen Plus programme, tickets corresponding to cargo, groups, excursions, transfers, all those with an implicit commercial discount and/or those fares whose conditions stipulate that they do not accumulate points.
9. The earning of points for other services associated with the programme will be published at the time of purchase.

USE OF POINTS

10. The points accumulated for the use of the services that give entitlement to them may be exchanged for the trips, gifts or services that are published at any given time, by means of the table that will be available to customers.
11. The points obtained for a service will be reflected and may only be used from the 1st day of the month following the one in which they were obtained and, in any case, never before the contracted service has been used.
12. It is not possible to accumulate points from different members of the programme to obtain tickets, hotel stays or other gifts. It is also not possible to buy a ticket by paying for it partially with points and partially with money.
13. Only the holder of the ticket will accumulate points. If the other passengers on the same ticket also have a Fred. Olsen Plus profile, they will not earn points. Passengers who wish to accumulate points must purchase and hold their own ticket separately.
14. To exchange points for travel, members can do so through any Fred. Olsen Express sales channels: website, mobile application, sales offices or phone contact centre.


In the case of exchanging points for gifts, they must be exchanged directly at the on-board shops on inter-island ferries. To exchange for stays at the Hotel Jardín Tecina, you must request it by telephone or email at our Contact Centre: https://www.fredolsen.es/en/customer-service.

15. The beneficiary of the use of the points can be the programme holder or the person or persons designated by the programme holder, but it must be the holder who makes the reservations and to whom the tickets are delivered.

INFORMATION TO THE HOLDER

16. Fred. Olsen Express will periodically inform the programme holder of the status of points accumulated and/or used.
17. Point holders can check their balance in several ways: at any Fred. Olsen Express sales point, on our website www.fredolsen.es, through our mobile app, at any Fred. Olsen Express sales office, or through our Contact Centre: https://www.fredolsen.es/en/customer-service
18. If the information is not correct, the holder may make the appropriate claim, providing the necessary documentation.

GENERAL

19. Fred. Olsen Express reserves the right to change the current points tables, terms and conditions or any other aspect of the programme at any time without prior notice.
20. The participation of programme partners may be cancelled at any time without notice.
21. The Fred. Olsen Plus programme may be cancelled by Fred. Olsen, S. A. with three months' notice, which is the last period that holders will have to obtain and use their points.
22. Fred. Olsen Express will not be liable in any case for any damages that may be caused due to the cancellation of the programme.
23. The Fred. Olsen Plus programme will be cancelled without notice or liability for Fred. Olsen, S. A., if at any time circumstances of force majeure or legal impositions occur that prevent its development.
24. The holder may terminate their participation in the programme by sending an e-mail to the following address: atencionalcliente@fredolsen.es. It is also possible to request cancellation of the programme through the APP, by logging in as a user and completing your request in the form that you will find at the bottom of the MY PROFILE section.
25. These General Terms and Conditions shall be governed by, complied with and enforced in accordance with Spanish laws and regulations.
26. For any question arising in the interpretation and application of these General Conditions, the parties, expressly waiving any other jurisdiction that may correspond to them, submit to the jurisdiction of the courts and tribunals of Santa Cruz de Tenerife.

DATA PROTECTION

Legitimation and purpose: The legal basis for the processing of personal data is the consent given by the owner of the personal data, authorising Fred. Olsen, S.A. to process and incorporate the personal data and those that may be provided by necessity, the purpose being the registration and participation in the loyalty programme, as a user, by means of their registration.
Conservation: The conservation of the data, associated with the loyalty programme, will be maintained for a period of 6 years from the last confirmation of use of the programme, unless the user requests cancellation.

The conservation of the e-mail account, for the sending of commercial communications, will be maintained indefinitely, unless the user requests the cancellation of the account by means of the procedures established for this purpose.

Updating / Modification: The registered person, acknowledges that the information and personal data collected or provided are accurate and truthful. For this reason, any modification of personal data must be communicated immediately so that the information contained in our records is always up to date and does not contain errors.
Transfer of data: There will be no communication of data to third parties, unless legally obliged to do so.
Processing of data by third parties: There will be no transfer of data to third parties.
Commercial communications: For the correct management of the loyalty programme, we will use the data provided, to send information of interest to you, commercial management, promotions, offers, draws, marketing actions and analysis, including communications by post, sms, e-mail or other electronic or similar means.
Rights: The data subject may request access, rectification and/or deletion of his/her data, as well as other rights, as explained in the additional information at https://fo.avisolegal.info/arco.html
